#فتاوى_عبر_الأثير (( 8 )) - السؤال:- رجل قال لزوجته (إذا خرجتي من المنزل خلال شهر فأنت طالق) فهل إذا خرجت بإذنه يقع الطلاق ؟ - الجواب:- قول السائل (إذا خرجتي من المنزل خلال شهر فأنت طالق) فهذا يسمى "بالطلاق المعلق بشرط " ،وهو غير الطلاق الصريح. - والطلاق الصريح كأن يقول :- (أنت طالق) فهذا يقع سواء قصد التهديد ،أو لم يقصد، وسواء كان مازحاً ،أو جاداً . - أما الطلاق المعلق بشرط إذا وقع الشرط ،وكان القصد الطلاق، فإنه يقع الطلاق بوقوع الشرط ،سواء أذن الزوج أو لم يأذن. - أما إن كان لم يقصد به الطلاق ،وإنما قصد المنع أو التهديد، فهي يمين مكفره على قول بعض أهل العلم. - ومكفره أي تجب فيها الكفارة إن وقع الشرط ،كالخروج من البيت هنا خلال المده المحدده. - والكفارة إطعام عشرة مساكين ،أو كسوتهم ،فمن لم يجد فصيام ثلاثة أيام، هذا والله تعالى أعلم .
